Mediation is a powerful tool that can help parties resolve disputes in a cooperative manner, allowing them to actively participate in finding a solution. Unlike court cases, where control is handed over to a judge or jury, mediation empowers parties to work together towards a mutually beneficial outcome.
The mediator’s role is to guide the parties through the process using their skills and experience to facilitate communication and encourage dialogue. They remain impartial throughout, providing information on possible outcomes without taking sides or making decisions.
Mediation sessions may include joint discussions and private meetings, with the mediator helping to draft a final agreement if reached. If no agreement is reached, the mediator will declare an impasse. Participants can choose to end the process at any time as mediation is a voluntary process.
Mediation is a cost-effective and non-confrontational way to resolve disputes, giving parties more control over the outcome. Sessions typically last a few hours to a day and are confidential if mandated by the court.
