Mandatory Homeowner Association Registration With Department Of Business And Professional Regulation

In changes made during the 2013 Legislative Session, House Bill 7119 made modification to Section 720.303 of Florida Statutes, adding a new subsection (13), which requires all homeowners associations to register with the Department of Business and Professional Regulation (DBPR) prior to November 22, 2013.  The DBPR has announced the creation of a website for homeowners associations to complete the registration at www.myfloridalicense.com/hoa.

The new legislation requires the community association manager or management firm for the association to complete the registration and, if there is no manager or management firm, a representative of the association is to complete the registration itself.  The information to be reported is (a) the legal name of the association; (b) the Federal Employer Identification Number of the association; (c) a mailing and physical address for the association; (d) the total number of parcels in the community that the association operates; and (e) the total amount of revenues and expenses from the annual budget of the association.  Similar requirements apply to homeowner association communities that are still under developer control.

If the registration is handled by a licensed community association manager on behalf of the association, the manager will log into the website using that manager’s user information with the DBPR.  If, however, the association is registered by a board member or other non-licensed individual, it is required to set up a user account with the DBPR to complete the registration process.

In that the deadline for registering is quickly approaching, it is recommended that this process be undertaken without delay.
